Ravens Use 'Hand' Gestures to Communicate

Ravens use their beaks and wings much like humans rely on our hands to make gestures, such as for pointing to an object, scientists now find.

This is the first time researchers have seen gestures used in this way in the wild by animals other than primates.

From the age of 9 to 12 months, human infants often use gestures to direct the attention of adults to objects, or to hold up items so that others can take them. These gestures, produced before children speak their first words, are seen as milestones in the development of human speech.

Dogs and other animals are known to point out items using gestures, but humans trained these animals, and scientists had suggested the natural development of these gestures was normally confined only to primates, said researcher Simone Pika, a biologist at the Max Planck Institute for Ornithology in Seewiesen, Germany. Even then, comparable gestures are rarely seen in the wild in our closest living relatives, the great apes?for instance, chimpanzees in the Kibale National Park in Uganda employ so-called directed scratches to indicate distinct spots on their bodies they want groomed.

Still, ravens and their relatives such as crows and magpies have been found to be remarkably intelligent over the years, surpassing most other birds in terms of smarts and even rivaling great apes on some tests.

"[What] I noticed when I encountered ravens for the first time is that they are, contrary to my main focus of research, chimpanzees, a very object-oriented species," Pika said. "It reminded me of my childhood, when my twin brother and I were still little and one of us suddenly regained a favorite toy, which existence both of us had forgotten for a little while. This toy suddenly became the center of interest, fun and competition. Similar things happen, when ravens play with each other and regain objects."

Beak gestures
To see if ravens communicated using gestures, scientists investigated wild ravens in Cumberland Wildpark in Gr?nau, Austria. Each bird was individually tagged to help identify them.

The researchers saw the ravens use their beaks much like hands to show and offer items such as moss, stones and twigs. These gestures were mostly aimed at members of the opposite sex and often led those gestured at to look at the objects. The ravens then interacted with each other?for example, by touching or clasping their bills together, or by manipulating the item together. As such, these gestures might be used to gauge the interest of a potential partner or strengthen an already existing bond.

"Most exciting is how a species, which does not represent the prototype of a 'gesturer' because it has wings instead of hands, a strong beak and can fly, makes use of very sophisticated nonvocal signals," Pika told LiveScience.

Origin of gestures
Ravens are known to possess a relatively high degree of cooperation between partners. These findings suggest that gestures evolved in a species that demonstrates a high degree of collaborative abilities, a discovery that might shed light on the origin of gestures within humans.

"Gesture studies have too long focused on communicative skills of primates only," Pika said. "The mystery of the origins of human language, however, can only be solved if we look at the bigger picture and also consider the complexity of the communication systems of other animal groups."

Jackson's family calls for stiff sentence for doc (AP)

LOS ANGELES ? A lawyer for Michael Jackson's family has told a judge sentencing the doctor who caused the singer's death that the family is not seeking revenge but wants a stiff sentence that serves as a warning to opportunistic doctors.

Attorney Brian Panish did not specifically request the maximum term of four years in jail for Dr. Conrad Murray, but said Tuesday the cardiologist should be punished in a way that reminds physicians that they cannot sell their services to the highest bidder.

Panish represents family matriarch Katherine Jackson and the singer's three children in a civil lawsuit.

The statement by Panish at a sentencing hearing included elements representing the views of Jackson's children, parents and siblings.

Murray was convicted on Nov. 7 of involuntary manslaughter.

More Americans hunted for bargains over the weekend than ever before as retailers lured them online and into stores with big discounts and an earlier-than-usual start to the holiday shopping season.

A record 226 million shoppers visited stores and websites during the four-day holiday weekend starting on Thanksgiving Day, up from 212 million last year, according to early estimates by The National Retail Federation released on Sunday. Americans spent more, too: The average holiday shopper spent $398.62 over the weekend, up from $365.34 a year ago.

Art and Anna Destrada from Port Chester, N. Y., were among the holiday shoppers. They started shopping on Thanksgiving evening at a Walmart store, went to various malls in New Jersey on Friday, and got some deals at Macy's on Saturday. They spent a total of $2,000 on gifts for themselves and others, including a Wii videogame console, clothing and jewelry.

"We've saved for Christmas and put away money all year," says Anna Destrada, 49. "We stayed within our means so we can make a few splurges."

The results for the first holiday shopping weekend show that retailers' efforts to lure shoppers during the weak economy are working. Some like Wal-Mart Stores Inc. and J.C. Penney have been making a stronger push online to better compete with the likes of rival Amazon.com. And major chains like Macy's, Target, Best Buy extended the traditional start to the shopping season by opening their doors at midnight on Thanksgiving evening instead of the pre-dawn Friday hours of years past.

But the question remains whether retailers' will be able to hold shoppers' attention throughout the remainder of the season, which can account for 25 to 40 percent of a merchant's annual revenue. After all, Americans are still very driven by deep discounting and they're more conscious of their spending budgets.

Overall, holiday spending is expected to grow by a modest 2.8 percent to about $466 billion, according to the NRF. A fuller picture on spending will come Thursday when major retailers report their November sales figures. But for now, experts agree that retailers will likely have to continue to discount to get shoppers to spend.

"The big question is: How do you close the season?" says Hana Ben-Shabat, a partner at A. T. Kearney's retail practice. "This is a very promotional driven shopper."

Indeed, the earlier hours ? which meant earlier door-buster deals ? on Black Friday seemed to be what drew many shoppers in over the weekend, particularly the younger crowd.

According to the National Retail Federation, 24 percent of Black Friday shoppers were at stores at midnight. That's up from 9.5 percent the year before when only a few stores were open during that time. Of those shopping at midnight on Black Friday, 37 percent were in the 18-to-34 age group.

"Black Friday has evolved from an early morning shopping activity to a late night entertainment," says Ellen Davis, spokeswoman at The National Retail Federation. "A lot of people stayed up until 1 a.m. or 2 a.m. to go shopping, and then went to bed."

The remainder of the day went well, too.

Mall of America, the nation's largest mall, broke its Black Friday record with about 210,000 shoppers. And Taubman Centers, which manages or leases 26 shopping centers in 13 states, says sales were up anywhere from mid- to low double digits on Friday, compared with a year ago.

Overall, Black Friday sales were $11.4 billion, up 7 percent, or nearly $1 billion from the same day last year, according to a report by ShopperTrak, which gathers data from 25,000 outlets across the country. It was the largest amount ever spent on that day and the biggest year-over-year increase since 2007. Additionally, customer counts climbed 5.1 percent that day compared with a year ago.

Online shopping on Black Friday was especially strong. Research firm comScore reported on Sunday that online spending jumped 26 percent on Black Friday to $816 million, compared with $648 million on the same day a year ago.

Some experts worry the strong start will cannibalize sales during the remainder of the season. Indeed, many people who headed to the malls after Black Friday weren't spending.

At the Crabtree Valley Mall in Raleigh, N.C., it was busy on Saturday, but many shoppers did not have bags. Likewise, at Pioneer Place mall in Portland, Ore., on Saturday, a number of shoppers were doing more window-shopping for the best deals than actual buying.

David Van Veen, 25, for one, says he was looking for deals on work clothes. But he says he'll likely wait to get gifts and other holiday items ? perhaps when the deals are better ? later in the season.

"I'll wait until Dec. 23 to start shopping I think," he says.

(AP) ? Herman Cain told aides Tuesday he is assessing whether the latest allegations of inappropriate sexual behavior against him "create too much of a cloud" for his Republican presidential candidacy to go forward.

Acknowledging the "firestorm" arising from an accusation of infidelity, Cain only committed to keeping his campaign schedule for the next several days, in a conference call with his senior staff.

"If a decision is made, different than to plow ahead, you all will be the first to know," he said, according to a transcript of the call made by the National Review, which listened to the conversation.

It was the first time doubts about Cain's continued candidacy had surfaced from the candidate himself. As recently as Tuesday morning, a campaign spokesman had stated unequivocally that Cain would not quit.

Cain denied anew that he had an extramarital affair with a Georgia woman who went public a day earlier with allegations they had been intimate for 13 years.

"It was just a friendship relationship," he said on the call, according to the transcript. "That being said, obviously, this is a cause for reassessment."

He went on: "With this latest one, we have to do an assessment as to whether or not this is going to create too much of a cloud, in some people's minds, as to whether or not they would be able to support us going forth."

Saying the episode had taken an emotional toll on him and his family, Cain told the aides that people will have to decide whether they believe him or the accuser. "That's why we're going to give it time, to see what type of response we get from our supporters."

Ginger White's accusation of an affair prompted New Hampshire state Rep. William Panek, who endorsed Cain at a news conference earlier this year, to pull his endorsement and instead support former House Speaker Newt Gingrich in the upcoming primary. Panek said he rethought his position when White showed evidence that she traded 61 text messages and cell phone calls with the candidate.

"I felt like we were being lied to," Panek said. "I'm putting my name in New Hampshire as a state rep behind him and I just didn't like the way it was being played out."

In Iowa, Cain's campaign has lost some precinct-level supporters in light of the new allegations, Steve Grubbs, Cain's Iowa chairman, said during an interview with CNN.

Cain was in Iowa for a day last week to film a new ad, but spending to air it was on hold pending the fundraising in the days to come, Grubbs said.

"If people make contributions, then we'll keep the campaign doors open and be able to keep paying people," Grubbs said. "Otherwise, Herman Cain will have to make a decision whether he can afford to keep moving forward."

Cain has denied the affair as well as several other accusations of inappropriate sexual behavior that have dogged his candidacy over the past month. He had been publicly resolute about pressing ahead even as his standing in public opinion polls and his fundraising started to slide.

But in the conference call, he pledged only to keep his imminent schedule, including a foreign policy speech at Hillsdale College in Michigan later Tuesday that he promised to deliver with "vim, vigor and enthusiasm."

Speaking to nearly 1,000 people at Hillsdale, a conservative bastion, Cain didn't address the affair allegation. He stuck to his plan to present his foreign policy vision, one in which the U.S. would stand by friendly nations such as Israel, quit giving money to countries he considered enemies, and spend more on defense.

"Rather than the current philosophy of cut, cut, cut, I believe our philosophy should be invest, invest, invest," he said. "I happen to believe that we have allowed our military to get too weak."

While Cain avoided reporters after the speech, he would hardly be able to escape them at an event from which he withdrew earlier in the day: a party in New York on Sunday to meet with some of the city's top journalists including NBC's Matt Lauer and ABC's Barbara Walters. Cindy Adams, the New York Post columnist hosting the dinner, told the AP she had received a call Tuesday from Cain adviser John Coale saying Cain had decided not to attend. Coale declined to comment.

Still, Cain was what one participant described as calm and deliberate as he addressed his staff on the conference call.

The participant, Florida state Rep. Scott Plakon, one of four chairmen for Cain's Florida campaign, said he wanted to see more evidence from the accuser.

"If it is true that he didn't do this, I think he should fight and kick and scratch and win," Plakon said.

But if Cain did have the affair, Plakon said, it would be unacceptable to Republican voters.

"That would be very problematic," he said. "There's the affair itself and then there's the truthful factor. He's been so outspoken in these denials."

After the conference call, Cain attorney Lin Wood told the AP: "Any report that Mr. Cain has decided to withdraw his candidacy is inaccurate."

"I think they are assessing the situation, just as I would expect the campaign to do or any prudent business person to do," said Wood. He added that he would hate to see what he described as false accusations drive Cain out of the race for the presidency.

On Monday, Ginger White said in an interview with Fox 5 Atlanta that her affair with Cain ended not long before the former businessman from Georgia announced his candidacy for the White House.

"It was fun," said White, 46, as she described Cain buying her plane tickets for a rendezvous in Palm Springs, Calif. "It was something that took me away from my sort of humdrum life at the time. And it was exciting."

Cain went on television to flatly deny White's claims even before the report aired.

"I didn't do anything wrong," he said then. On Tuesday, he told his staff "I deny those charges, unequivocally," and went on to say he had only helped White financially "because she was out of work and destitute, desperate."

Seemingly out of step with Cain's denials, his lawyer issued a statement Monday that included no such denial of the affair and suggested that the media ? and the public ? had no business snooping into the details of consensual conduct between adults.

Cain's response was faster and more deliberate than he had managed when it was reported that three women alleged he had sexually harassed or groped them when he was the president of the National Restaurant Association in the mid- to late 1990s. The trade group paid settlements to two women who had worked there.

As some conservative Republicans sought an alternative to Mitt Romney, Cain surged in the polls while pushing his 9-9-9 tax plan and providing tough criticism of President Barack Obama during televised debates.

But as the harassment allegations surfaced, Cain stumbled in explaining his views about U.S. policy toward Libya and other foreign policy issues, creating an opening for rival Newt Gingrich to assert himself as a more reliable, seasoned politician to challenge Romney and even Obama. Cain fell in the polls and Gingrich began to rise.

In an email sent Tuesday to his supporters, Cain called the allegations of the affair "a fabricated, unsubstantiated story." He accused White of abusing their friendship.

"I am writing you today to assure you that this woman's story is completely false," Cain said in the email. "I do know Ms. White. I have helped her financially at times over the past few years, just as I have helped many friends and acquaintances throughout the years. I thought Ms. White was a friend in need of a supportive hand to better her life."

In her TV interview, White said she decided to come forward after seeing Cain attack his other accusers in an appearance on television.

J.R. Martinez Honored By U.S. Defense Department, Named Rose Parade Grand Marshal


Let the J.R. Martinez victory tour begin.

Dancing With the Stars champion J.R. Martinez received an invitation from U.S. Defense Secretary Leon Panetta to visit the Pentagon and meet Panetta in person.

According to The Hollywood Reporter, Panetta's respect for J.R., an Iraq War veteran, motivational speaker and actor, was displayed in a congratulatory note:

"Your strength and spirit have captivated the nation, and your victory sends a strong message about the strength and resilience of our wounded warriors."

The Defense Secretary then personally called J.R. to invite him to meet in person. J.R. Martinez will address thousands of active and retired troops while in D.C.

It seems everyone wants a piece of the man. Along with his journey to the Pentagon, Martinez has been named the Grand Marshal of the 2012 Rose Parade. 

The annual extravaganza takes place New Year's Day. Not only that, the 28-year-old will co-host the pre-show of CNN's Heroes: An All-Star Tribute.

If you're looking for a true inspiration, you could do a lot worse.

Syracuse fires assistant basketball coach Fine

SYRACUSE, N.Y. (AP) - Syracuse University associate head basketball coach Bernie Fine was fired Sunday in the wake of an investigation of child molestation allegations against him.

"At the direction of Chancellor Cantor, Bernie Fine's employment with Syracuse University has been terminated, effective immediately," Kevin Quinn, the school's senior vice president for public affairs, said in a statement.

The 65-year-old Fine was in his 36th season at his alma mater. He had the longest active streak of consecutive seasons at one school among assistant coaches in Division I.

Fine's firing comes in the wake of new revelations Sunday, including a third accuser. Fine had been placed on paid administrative leave when the accusations were first made public.

Two former Syracuse ball boys were the first to accuse Fine, who has called the allegations "patently false."

Zach Tomaselli, 23, of Lewiston, Maine, said Sunday that he told police that Fine molested him in 2002 in a Pittsburgh hotel room. He said Fine touched him "multiple" times in that one incident.

Tomaselli, who faces sexual assault charges in Maine involving a 14-year-old boy, said during a telephone interview with The Associated Press that he signed an affidavit accusing Fine following a meeting with Syracuse police last week in Albany.

Tomaselli's father, meanwhile, maintains his son is lying.

Two former Syracuse ball boys were the first to accuse Fine, who has called the allegations "patently false."

Bobby Davis, now 39, told ESPN that Fine molested him beginning in 1984 and that the sexual contact continued until he was around 27. A ball boy for six years, Davis told ESPN that the abuse occurred at Fine's home, at Syracuse basketball facilities and on team road trips, including the 1987 Final Four.

Davis' stepbrother, Mike Lang, 45, who also was a ball boy, told ESPN that Fine began molesting him while he was in fifth or sixth grade.

On Sunday, ESPN also played an audiotape, obtained and recorded by Davis, of an October 2002 telephone conversation between him and Bernie Fine's wife, Laurie.

Davis told ESPN he made the recording, which also has been given to Syracuse police, without her knowledge because he knew he needed proof for the police to believe his accusations. ESPN said it hired a voice recognition expert to verify the voice on the tape and the network said it was determined to be that of Laurie Fine.

During the call to the woman, Davis repeatedly asks her what she knew about the alleged molestation.

"Do you think I'm the only one that he's ever done that to?" Davis asked.

"No ... I think there might have been others but it was geared to ... there was something about you," the woman on the tape said.

On the tape, she also says she knew "everything that went on."

"Bernie has issues, maybe that he's not aware of, but he has issues. ... And you trusted somebody you shouldn't have trusted ... "

During his long career with Syracuse, Fine tutored the likes of Derrick Coleman, LeRon Ellis and John Wallace in his role of working with post players. Coleman was the top pick in the 1990 NBA draft, Ellis was the Clippers' 22nd overall choice in 1991, and Wallace was picked 18th in 1996 by the New York Knicks.

Boeheim and Fine met at Syracuse University in 1963, when Fine was student manager of the basketball team. Fine graduated in 1967 with a degree in personal and industrial relations and went into business for himself.

In 1970, Fine was named basketball and football coach at Lincoln Junior High in Syracuse and went to Henninger High School the next year as the junior varsity basketball coach. He became varsity basketball coach in 1975. When Boeheim was chosen to succeed Roy Danforth at Syracuse in 1976 Boeheim offered Fine a job as an assistant.

Fine was an integral part of the staff that guided Syracuse to the national championship in 2003. During his tenure the Orange also made two other appearances in the NCAA title game, losing in 1987 to Indiana and in 1996 to Kentucky.

Fine also guided the U.S. Maccabiah team to a silver medal at the 1993 World Maccabiah Games in Israel and has served as director of a successful basketball camp in the Northeast.

Fine, who always aspired to be a college head coach, got his chance when he substituted for Boeheim in 2001 when Boeheim missed the only two games of his coaching career following treatment for an enlarged prostate.

Syracuse has 40 straight winning seasons, the longest active streak in Division I, and Boeheim has 33 20-win seasons, also tops in Division I.

On Friday, federal authorities carried out a search at his Fine's suburban Syracuse home but declined to comment on what they were looking for.

New York State Police spokesman Jack Keller said troopers were called to assist the U.S. attorney's office at the search. At least six police vehicles were parked on the street during the search, which lasted around nine hours. Officers carted away three file cabinets and a computer for further examination.

Oil prices rise on holiday sales, Europe hopes (AP)

Oil prices climbed above $98 per barrel Monday after shoppers pumped up holiday retail sales in the U.S., and investors bet that Europe would find a last-minute solution to its financial crisis.

Here's how energy prices traded.

On the New York Mercantile Exchange:

Benchmark crude rose $1.44 to end the day at $98.21 per barrel.

Gasoline rose 6.92 cents to finish at $2.5181 per gallon.

Heating oil rose 4.26 cents to end at $2.9699 per gallon.

Natural gas lost 17.8 cents to finish at $3.364 per 1,000 cubic feet.

On the ICE Futures exchange in London:

Brent crude rose $2.26 to end at $108.02 per barrel.

Morocco's Arab Spring election won by Islamists

The victory of an Islamist Party in Morocco's parliamentary elections appears to be one more sign that religious-based parties are benefiting the most from the new freedoms brought by the Arab Spring.

Across the Middle East, parties referencing Islam have made great strides, offering an alternative to corrupt, long serving dictators, who have often ruled with close Western support.

The Justice and Development Party dominated Morocco's elections through a combination of good organization, an outsider status and not being too much of a threat to Morocco's all-powerful king.

By taking 107 seats out of the 395 seats, almost twice as many as the second place finisher, the party ensured that King Mohammed VI must pick the next prime minister from its ranks and to form the next government out of the dozen parties in Morocco's parliament.

It is the first time the PJD ? as it is known by its French initials ? will be part of the government and its outsider status could be just what Morocco, wracked by pro-democracy protests, needs.

Although it didn't bring down the government, the North African kingdom of 32 million, just across the water from Spain, was still touched by the waves of unrest that swept the Arab world following the revolution in Tunisia, with tens of thousands marching in the streets calling for greater freedoms and less corruption.

The king responded by modifying the constitution to give the next parliament and prime minister more powers, and held early elections.

But there was still a vigorous movement to boycott the elections. There was only a 45 percent turnout in Friday's polls, and many of those who went to vote turned in blank ballots or crossed out every party listed to show their dissatisfaction with the system.

Election observers from the U.S.-based National Democratic Institute estimated that up to a fifth of the ballots they saw counted had been defaced in such a way.

In the face of such widespread distrust of politics, historian and political analyst Maati Monjib said a government led by a new political force could be the answer.

"If the PJD forms a coalition in a free and independent way and not with a party of the Makhzen," he said referring to the catch-all phrase for the entrenched establishment around the king, "this will be a big step forward for Morocco."

In Tunisia, Morocco, and on Monday most likely also Egypt, newly enfranchised populations are choosing religious parties as a rebuke to the old systems, which often espoused liberal or left-wing ideologies.

"The people link Islam and political dignity," said Monjib, who describes himself as coming from the left end of the political spectrum. "There is a big problem of dignity in the Arab world and the people see the Islamists as a way of getting out of the sense of subjugation and inferiority towards the West."

Like the Ennahda Party in Tunisia, the PJD is also from the more moderate end of the Islamist spectrum. The party's leader, Abdelilah Benkirane, supports a strong role for the monarchy and the movement has always been careful to play the political game.

The party doesn't describe itself as "Islamist" but rather as having an Islamic "reference," meaning that its policies follow the moral dictates of the religion.

The PJD has also avoided focusing on issues like the sale of alcohol or women's headscarves that have obsessed Islamist parties elsewhere in the region, and instead has talked about the need to revamp Morocco's abysmal education system, root out rampant corruption and find jobs for the millions of unemployed.

Mohammed Tozy, a professor of politics and prominent expert on Islamic movements, said the party has always had support in society, but in this election it managed to broaden its appeal.

"What they lacked before was the confidence of the public and now they have been able to go beyond their traditional constituency and give assurances to the business and middle class that they weren't totally Islamist," he said.

Part of the new success of Islamist parties across the region is due to the Turkish model. An Islamist party has been in power in Turkey for almost a decade now and has shown that "modernity and Islam can be allied effectively," said Tozy.

In Morocco, the PJD is widely acknowledged as being the best organized in the country, relying on grass roots networks to promote candidates rather than just enlisting prominent local figures to attract votes.

It also benefited from the push for change in the country and the discrediting of the parties closely associated with the status quo. In particular, the Party of Authenticity and Modernity formed by a friend of the king, which was the largest in the outgoing parliament, lost seats in the new elections.

The PJD has had an ambivalent relationship with the activists of the pro-democracy movement. Several high-ranking party officials joined the street demonstrations and expressed their solidarity, while Benkirane himself warned against the protests ? possibly to stay in the palace's good graces.

It would not be the first time that Morocco's kings have looked to the opposition for help. In the final years of his reign, the current king's father, Hassan II, brought the leftist Union of Progressive Socialist Forces into the government for the first time, even letting its leader serve as prime minister.

Little changed and the party lost much of its cachet in society and has since plummeted in the polls.

Monjib said, however, that if Morocco is going to make it out of its current political crisis, this kind of manipulation must end.

"The palace can't keep playing the game of emptying the parties of their substance, marginalizing them with the citizens, giving them the semblance of power, but not real power so they lose credibility," he said.
